Year 2004

ANNUAL NEWSLETTER: HOLIDAY 2004

As another year is fast approaching, it is especially gratifying to review your notes of thanks upon completion of the matters I have assisted you with over the past year. Thank you.

It is a real treat for me to be acting for the Children and Grandchildren of many of my clients. Not only am I helping the next generation with the purchase of their first homes, Wills and Powers of Attorney but also with plans to help them best assist their parents and grandparents as they age. I appreciate the loyalty and privilege of working with, in many cases, three generations of the same family.

On a more technical note, I have completed my move to a full e-service environment. Wired Web access was available in my offices since 2003 but this past year I have made available Wi-Fi wireless access for your convenience. My laptop is wireless so I can respond to your emails and faxes when I am not in the office or at home. Real Estate Conveyancing has moved wholly to the Web with this year's introduction of RealtiPLUSWeb and electronic funds transfer, both of which I now use. My Web Site is fast becoming an extranet to even better serve your needs in this global village we live in.

Family Law has undergone another reformation as of July 1st 2004. In theory, every court in the Province will now operate under the same system with the same rules and forms. The system was revamped in order to settle matrimonial matters faster and in a less combative matter. The Supreme Court of Canada has ruled on the legality of same sex marriage throughout Canada. This will have enormous ramifications on same sex couples. The same laws will apply for pension sharing, income splitting, division of property and assets for same-sex couples who marry. Therefore I urge all of my clients who are contemplating marriage, or living together, to give very serious consideration to signing a cohabitation agreement or marriage contract. A cohabitation agreement does not signify a lack of trust in a new relationship. Rather, it shows complete trust in your partner.

I wish you a peaceful holiday season and a healthy and happy new year.

Yours truly,

Howard S. Dyment, LL.B.
